Job Summary:
The VP, Assistant General Counsel – Claims & Carrier Compliance will lead the Company’s claims and carrier compliance teams. The claims team is responsible for legally sound and fiscally responsible management of the Company’s bodily injury, property damage, workers’ compensation, subrogation and cargo claims. The carrier compliance team has responsibility for the vetting, approval, and onboarding of third-party motor carriers for the Company’s brokerage and final mile business operations. The successful candidate will provide advice and support for all legal and operational issues related to claims management and carrier compliance for the Company.
This role reports to the EVP – Chief Legal Officer and partners with cross-functional teams (e.g., operations, safety, insurance, legal and finance) and business leadership to provide cost-effective results. The successful candidate will have significant litigation (including trial) experience across a range of cases involving bodily injury and property damage with expertise in incident response, claims investigation, claim valuation, trial strategy, settlement negotiations, and case reserves. The role requires a pragmatic and collaborative approach to working with colleagues and outside counsel to effectively and efficiently address claims, as well as a proactive approach to identifying and implementing loss prevention improvements. In addition to leading the internal teams, the role involves providing oversight and direction to the company’s third-party claims administrator, outside defense counsel, and other outside vendors.
Essential Job Functions:
- Provide pro-active and strategic management of the Company’s bodily injury, property damage, workers’ compensation, and cargo claims to achieve optimal legal and financial outcomes
- Manage the Company’s claims handling processes and provide leadership to claims team
- Manage the Company’s carrier compliance processes and provide leadership to the carrier compliance team
- Oversee all aspects of outside counsel representation of the Company in claims matters, including selection of counsel, quality of representation, strategy, negotiations, budgeting, and cost management
- Lead internal claims reporting, including working within the Company’s framework for reserve setting, escalation, authority, insurance, etc.
- Present claims, strategy, and performance data to executive management
- Develop metrics for measuring claims handling performance and the performance of claims team
- Work with safety and operations teams to identify and implement process improvements that enhance loss prevention
- Attend mediations and monitor trials on behalf of the Company as needed
- Proactively identify and help drive continuous improvement in claims and compliance processes
- Understand the intricacies of the Company’s business model and strategic objectives and how they should be supported by the Legal team
- Provide support for Company and Legal team initiatives outside of core areas of responsibility as needed
- Provide support for the Company’s engagement with insurance markets and the placement of its insurance coverage
Minimum Qualifications:
- Bachelor’s Degree and a JD from an accredited law school
- Active member in good standing of Illinois bar or qualified for obtaining status as authorized House Counsel in Illinois
- At least eight years of experience litigating bodily injury and property damage claims in a well-regarded law firm, with jury trial experience strongly preferred
- Preference for additional in-house experience managing claims team
- Preference for experience with litigation involving truck/vehicle accidents
- Familiarity with accident investigations and incident response
