Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.

 

Pay: $106,090.00 Annually

 

Position Summary: The primary duty of the position is to represent the Florida Department of Revenue in litigation in the state courts and in the Division of Administrative Hearings. Cases involve matters related to tax assessments, refund claims, and ad valorem (property tax) issues statewide. The Bureau’s cases often involve statutory interpretation and defending the constitutionality of statutes. The attorney may be assigned to cases both at the trial and appellate levels. At the trial level, the cases may be before a judge or an administrative law judge.

 

Qualifications: 

  • Admission to the Florida Bar and six years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.
  • The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

 

The Work You Will Do: This position’s duties include but not limited to the following:

  • Research and draft pleadings, motions, discovery, memoranda, briefs, orders, and other documents.
  • Develop litigation strategy in conjunction with the client, prepare witnesses for depositions and trial, conduct discovery, and prepare for trial or hearing.
  • Independently representing the Department in medium to high-complexity bench trials, administrative hearings, and appellate proceedings, and to co-counsel on other matters.
  • Occasionally be required to participate in short-term projects involving legal duties of this office in the representation of the State. 
  • Develop and maintain a high level of expertise in state tax litigation, including reading judicial decisions, CLEs, and from any other appropriate source.
  • Expected to not need direct supervision in day-to-day handling of assigned cases.
  • Provide first-line assistance and advice to other attorneys in case and litigation issues.
  • Coordinating work assignments with co-counsel, legal assistants, paralegal specialists, and interns.
  • Attending bureau staff meetings.
  • Preparing travel vouchers, time records and case status reports
  • Filing documents, etc.
  • May assist the Chief Assistant Attorney General as required.
  • Complete special assignments and perform related duties as assigned.

 

Preference may be given to applicants who have previous civil, administrative, or appellate litigation experience.
