As Director, Senior Counsel, Digital & Technology, you will provide leadership, coordination, and oversight of legal support for Alcon’s digital initiatives, the Digital Transformation team and Alcon’s digital enterprise strategy globally (with a focus on the US), including supporting on digital related products, e-commerce platforms, B2B and B2C initiatives, artificial intelligence projects and data analytics and rights. Director, Senior Counsel, Digital & Technology is part of the North America Legal Team within the Legal & Compliance function and works under the direction of the Head, Legal, North America and Global Franchises with a dotted line report to the Global Head of Data Privacy.

In this role, a typical day will include:

  • Serve as a primary legal point of contact for Alcon’s Digital Transformation Team and digital initiatives and enterprise strategy, including support of all digital related products and services.

  • Quickly and accurately identify, communicate, and devise appropriate mitigation strategies on legal risks as they apply to Alcon’s digital strategy and initiatives, including in the areas of data privacy and data rights, global privacy regulations, artificial intelligence, healthcare regulations, financial regulations and competition law.

  • Be responsible for implementing appropriate programs and safeguards by engaging at an early stage on digital project(s)’ design, development, data management and assessment of business needs and plans ensuring up-front legal compliance through pragmatic regulatory and business advice in close collaboration with the applicable business franchise commercial legal and compliance leadership team and legal subject matter experts.

  • Build and maintain collaborative relationships across Alcon functions including with the Digital Transformation Team, Global Head of Data Privacy and the regional and local privacy officers, Legal & Compliance teams, IT and InfoSec, R&D, Finance, Regulatory and Market Access and other global colleagues.

  • Ensure accountability within digital teams for legal/regulatory compliance as well as provide strategic advice and management on digital related partnering, sourcing and other commercial activities.

  • Lead in the negotiation and preparation of contracts with third parties in support of Alcon’s digital initiatives.   

  • Be responsible for training, education and raising awareness for legal and compliance for all digital related teams and do so in an innovative and engaging way.

  • Perform such other tasks and responsibilities as may be assigned by the Head, Legal, North America and Global Franchises and/or the Global Head of Data Privacy.

WHAT YOU'LL BRING TO ALCON:

Key Requirements/Minimum Qualifications

  • Bachelor’s Degree and Juris Doctorate 

  • The ability to fluently read, write, understand, and communicate in English

  • Work hours: Standard, Full-Time

  • Travel Requirements: Up to 10%

  • 10 years directly related experience, to include 7 years of leading people 

PREFERRED SKILLS AND EXPERIENCE:

  • 10 years related experience, preferably in the medical device or other healthcare industry with prior experience with software-based and/or software-enabled products and services.

  • Strong knowledge of global cybersecurity and HIPAA and other privacy requirements.

  • Strong knowledge of healthcare regulations (including familiarity and experience advising with regard to anti-kickback statutes and FDA requirements).

  • Strong knowledge of digital, cloud-based and software-focused systems, services and products and agile ways of working.

  • Working knowledge of artificial intelligence, including generative AI, and ability to keep up with emerging trends and risks in the AI space.

  • Extensive experience negotiating and preparing contracts in the digital and IT space.

  • Must have good business acumen and be solution and customer oriented.

  • The ability to read, write, understand, and communicate fluently in English.
