Summary
The Commercial Manager is responsible for all contractual aspects of a project from bid preparation until successful completion of the contract. This includes risk identification, assessment, and mitigation as well as claim management with customers and suppliers. Additional responsibilities include price and margin review of all product lines, price integrity, quotation development and overall departmental improvements.
In this role, the candidate must be able to work effectively and accurately across multiple topics simultaneously, organizing and setting task priority while building and maintaining positive relationships with internal and external customers. The individual must be able to develop quick and concise resolution of issues and will take lead direction from the Director of Sales – Corporate Accounts.
Your tasks
- Reviews all sales contracts to best identify and assess risk during all stages of the process and advise the organization such that suitable actions can be implemented to minimize the risks identified.
- Ensure all contractual conditions of the tender are fully understood, analyzed, and assessed.
- Assists the Project Team for all commercial topics by developing strategies and providing recommendations to limit, restrict and (or) transfer company risk exposure as well as potential financial and business impact arising from the customer/suppliers’ contractual conditions.
- Supports the project team in identification and preparation of claims, develops claim and negotiation strategy based on profound contract knowledge and liaison with internal and external counsel.
- Active along with the Finance team in the preparation and review of terms and conditions, inclusive of understand impact(s) of cash flow, etc.
- Compiles and writes training material and conducts training sessions on claim management, contractual risk, mitigation strategies and departmental process optimization.
- Manages issuance and maintenance of required contractual securities (bonds, letters of credit, parent company guarantee, etc.) and insurance policies related to the contracts.
- Responsible for improving the business using data analytics to assess processes, determine requirements and deliver data-driven recommendations and reports stakeholders.
- Engage with business leaders and users to understand how data-driven changes to processes, products, and services can improve efficiencies and add value. Work with data sets to improve products, services or processes that impact achieving business and sales key performance indicators and meeting customer requirements.
- Responsible for creating new models that support business decisions by working closely with financial reporting and IT teams to establish initiatives and strategies to improve and optimize costs. A strong understanding of reporting requirements as well as experience in forecasting, budgeting and financial analysis combined with understanding of key performance indicators.
