Job Description

Title: Assistant Attorney General

Unit: Pharmacy Benefits Manager Compliance and Enforcement Unit (“PBM Unit”)

Salary Range: Commensurate with experience and qualifications

Location: Oklahoma City, OK

Schedule: Full-time

Position Summary:

The PBM Compliance & Enforcement Unit ensures that Pharmacy Benefits Managers (PBMs) comply with the Patient’s Right to Pharmacy Choice Act, Pharmacy Audit Integrity Act, and other related Oklahoma statutes and regulations.  The successful candidate for this position will file and litigate administrative actions against PBMs that violate the applicable laws, represent the State in civil court actions involving PBMs as necessary, and take other enforcement actions as appropriate.    

Job duties and responsibilities may include, but are not limited to, the following:

  • Consult with PBM agents, analysts, and other attorneys to identify unlawful activities and develop cases for enforcement actions.
  • Guide investigations drawn from PBM complaint data, analyst data, and other sources to include drafting and issuing investigative demands and reviewing information produced in response. 
  • Conduct legal research and draft legal memorandums to support case preparation and strategy for PBM enforcement actions.
  • Prepare and file enforcement actions; conduct discovery, including drafting and responding to discovery requests, document review, selecting and preparing experts, and taking depositions; draft motions and briefing; represent the office in court hearings and settlement conferences; and take matters to trial as needed.
  • Collaborate with other agencies and states as appropriate to further the purposes of the unit. 
  • Attend available trainings to further develop knowledge of the PBM industry.
  • Stay abreast of current and emerging developments and trends in the PBM landscape, including proposed state and federal legislation, prominent investigations and litigation, and industry initiatives. 
  • Participate in community outreach and public education events to provide information on the state’s PBM laws. 
  • Some travel may be required.
  • Other duties as assigned. 

Minimum Qualifications:

Must be, or be eligible to become, licensed attorneys in good standing with the Oklahoma State Bar. Effective research, writing, and advocacy skills are required.  Applicants must also be able to interpret and analyze complex laws, regulations, and other information.  Applicants with experience in administrative law practice or civil litigation are strongly preferred.
