Position Overview: We are seeking a highly experienced and dedicated Senior Privacy Lawyer with a global focus on monitoring the implementation of Privacy by Design (PbD) within our Neuromodulation and CardioPulmonary business units. The successful candidate will play a critical role in shaping our products and services to uphold the highest standards of privacy and data protection from their inception through development and implementation. This position reports directly to the Chief Privacy Officer.

Responsibilities:

Global Privacy by Design Leadership: Lead and advise cross-functional teams on integrating privacy and security requirements and best practices into the design and development of new products, services, and features. Develop and implement a compliance strategy that focuses on identifying and interpreting applicable data protection laws and regulations both during the development and throughout the lifecycle of the company’s software/hardware products. Serve as the primary legal advisor to the R&D and product organizations on data protection requirements.

Policy Development: Develop and maintain comprehensive privacy policies, procedures, and guidelines tailored to the company’s R&D activities, ensuring compliance with relevant laws, regulations, and industry standards.

Risk Assessment and Mitigation: Conduct Data Protection Impact Assessments (DPIAs) and similar risk assessments to identify potential privacy and security risks associated with new R&D initiatives and vendor engagements and provide strategic guidance on risk mitigation measures.

Training and Awareness: Develop and deliver privacy training programs and materials to educate R&D and product teams on privacy laws, regulations, and best practices, fostering a culture of privacy awareness and compliance.

Cross-Functional Collaboration and Advocacy: Collaborate with internal stakeholders, including product managers, developers, engineers, and data scientists, to advocate for privacy-centric design principles and facilitate cross-functional dialogue on privacy-related issues. Ensure global legal privacy requirements are understood and effectively embedded into product features.

External Engagement: Stay abreast of emerging privacy laws, regulations, and industry trends related to data protection relevant for the R&D and product functions, and represent the company in relevant industry forums, working groups, and regulatory proceedings. Engage with external counsel and privacy advocacy groups to stay informed and influence the company's privacy by design approach.

Incident Response: Provide legal guidance and support in responding to information security incidents involving R&D activities, including assisting in investigations and managing notifications and regulatory inquiries.

Qualifications:

  • Juris Doctor (JD) degree from an accredited law school and active membership in good standing with the bar association.

  • Minimum of 7-10 years of experience practicing law, with a focus on privacy, data protection, and technology law.

  • In-depth knowledge of global privacy laws and regulations, including GDPR, HIPAA, CCPA, and other relevant frameworks, as well as industry standards such as ISO 27701.  Knowledge of FDA regulations preferred.

  • Proven experience in advising on privacy issues related to R&D, product development, and emerging technologies, preferably within the medical device industry.

  • Strong analytical skills and the ability to assess complex legal and regulatory issues and provide practical, business-oriented solutions.

  • Excellent communication and interpersonal skills, with the ability to effectively collaborate with cross-functional teams and influence stakeholders at all levels of the organization.

  • CIPP/E, CIPP/US, or other relevant privacy certifications are preferred.

Location: Remote

Travel Requirements: This position may require occasional business travel 25% or more of the time (Houston or OUS).
