The primary objectives of this position are to receive account referrals from the Loss Recovery Department and assess the viability of pursuing the customer for the deficiency through the legal process; prepare the account for either in-house action or referral to an outside attorney firm; establish contact with the customer after initial demands for payment have been issued; negotiate stipulated settlements or other payment arrangements if warranted; follow up on all steps and actions necessary for successful prosecution of AutoNation Finance’s case for a judgment against the customer, including preparing the summons and complaint and overseeing the matter to judgment, as well as preparing post-judgment writs of garnishment or levy, as applicable.
This individual will have significant interaction with external entities such as attorneys, civil courts, including clerks and judges, and vendors as a service-recipient. Internally, this position has a dependency on the Loss Recovery department for account referrals, and has substantial lines of communication with the Legal and Collections departments.
The successful candidate is self-directed in work prioritization and demonstrates superior judgment-making ability within the scope of the position’s areas of responsibility. The associate will perform all duties in accordance with AutoNation Finance’s policies and procedures and all state and federal regulations.

ESSENTIAL DUTIES
- Receives referrals from the Loss Recovery Department, who assessed the viability of pursuing the customer for the deficiency through the legal process, including verification of attachable assets such as real property or income.
- Determines whether to prepare a lawsuit in-house (California claims) or refer to an outside attorney (out of state claims).
- For California claims, prepares the Summons and Complaint and other required documents needed to file the lawsuit, and for out of state accounts, forwards the required information to local outside counsel to prepare the lawsuit.
- Manages the case throughout the litigation process, preparing required filings (e.g., case management statements) and calendaring for upcoming hearings and tracking dates throughout the stages of the lawsuit. If the customer files an answer, works with the customer or his/her attorney if represented to try to resolve the matter. If no answer is filed, prepared the default judgment package for filing.
- Performs income and asset searches post-judgment, prepares writs of garnishment or levy for execution when assets or places of employment are found.
- Tracks disbursements and prepares subsequent writs, as necessary, and if the matter was referred to an out of state attorney, coordinates with counsel for disbursements to be applied to the account.
- Tracks invoices and prepares requests for payment of court costs and other filing fees, as applicable.
- Tracks judgments to ensure timely renewal, prepares renewal documents as needed.
- Maintains and updates a civil litigation court calendar.

- Familiarity with basic state and federal collection laws, including the FDCPA.
