Description

We are seeking to recruit a Commercial Manager to join the EPUK Construction team.

The Commercial Manager will manage all commercial interactions relating to claims, variations, payments and correspondence between contractors, as well as the employers of the various EPC/EPCM contracts.

Key Responsibilities

Reporting to the Director of Commercial Finance (GB North), the key responsibilities and duties include:
  • Managing the delivery of all commercial and contractual aspects of the various construction projects, ensuring a robust management of change process is followed, with appropriate authorisation gates, to minimise risk and maximise opportunities. 
  • Establishing monitoring tools, processes, procedures and dashboards to accurately report on the overall commercial status of the project, key open issues and outturn forecasts, whilst preparing high quality commercial reports as required. 
  • Supporting the development of appropriate commercial strategy whilst maintaining an in-depth understanding of both the contractors’ and client’s obligations under all package contracts. 
  • Identifying and managing commercial risk, ensuring these are known and understood with particular regard to how they may impact ongoing decision making from the project team, whilst establishing risk mitigation measures as required. 
  • At a project level, maintaining relationships with key contract partners and managing commercial issues such as variations and claims.  
  • Leading on commercial events significant to the project as required - assessing options, developing strategy, preparing fully compliant contractual notices and ensuring that the business is prepared to deal with the consequences of actions taken. 
  • Providing advice on contractual issues to the project team (and wider business), including ensuring strict compliance with contractual provisions. 
  • Managing the dispute resolution process including driving and supporting negotiation strategies, advising on strategy for resolving all open issues and providing support to formal and / or alternative dispute resolution. 
  • Providing supervision and scrutiny to ensure milestone payments are administered correctly, correspondence is accurately recorded and stored and contemporaneous records kept. 

Skills, Knowledge and Expertise

Background
  • Demonstrable track record of managing construction and engineering commercial contracts. 
  • Experience of the engineering construction industry, including off-site manufacturing, construction and MEICA installation, UK safety legislation and CDM. 
  • Experience of engaging and facilitating strong relationships with key internal and external stakeholders, to build a team capable of delivering success. 
  • Experience of claims management and dealing with contractual issues on complex multi-package projects. 
  • Excellent technical skills that can be demonstrably leveraged in the role to deliver exceptional project outcomes. 
  • Highly IT literate, including MS Office software (Outlook, Excel, Word), and ability to organise and maintain electronic records in a logical manner.
  • Understanding of general contract law.
  • Working knowledge of various forms of contract, including FIDIC and MF1.

  • Confidence and ability to take decisions balancing commercial and technical requirements to achieve the best outcome for the project. 
Qualifications
  • Degree or equivalent in a relevant discipline.
  • Membership of an appropriate professional institution.
