Position Summary

The State Equal Opportunity Officer is a part of the Human Resources Division and serves as the liaison with the U.S. Department of Labor's Civil Rights Center for recipients and sub-recipients of federal awards in accordance with WIOA.  This position ensures compliance with the Workforce Innovation and Opportunity Act (WIOA) Section 188 and Title 29 CFR Part 38, develops the state's equal opportunity strategic initiative, monitors sub-recipients, and receives, investigates and resolves complaints of discrimination and other related violations of applicable state and federal policies, laws, and guidelines.

Position Essential Functions

The typical functions include, but are not limited to the following:

  • Implements equal opportunity, non-discrimination, and other related programs ensuring compliance with the Workforce Innovation and Opportunity Act (WIOA) Section 188 and Title 29 CFR Part 38, Americans With Disabilities Act, the Rehabilitation Act of 1973, the Civil Rights Acts of 1964 and 1991, the Age Discrimination in Employment Act, Equal Pay Act, the Oklahoma Civil Service and Human Capital Modernization Rules, and other applicable laws, regulations, rules, and guidelines.
  • Develops the OESC's procedures for processing discrimination complaints under 29 CFR 38.72 through 29 CFR 38.73, including tracking the discrimination complaints filed and publishing procedures for investigating and resolving discrimination complaints.
  • Conducts outreach and education about equal opportunity and non-discrimination requirements consistent with §38.40 including how an individual may file a complaint consistent with §38.69.
  • Designs and delivers training for WIOA state administrative staff and Local Workforce Development Boards.
  • Communicates with the Civil Rights Center and the United States Department of Labor attending local, regional, and national meetings as required. 
  • Monitors equal opportunity and non-discrimination activities and obligations under WIOA and 29 CFR 38; communicates compliance decisions or areas of concern to internal and external customers including recommended corrective actions.
  • Collects and maintains records of complaints or policy issues and provide reports outlining compliance with equal opportunity and non-discrimination.
  • Coordinates continuous improvement of OESC's Non-Discrimination Plan and other equal opportunity policies and practices.
  • Assists management, legal counsel, and others in resolving actions with courts, the Civil Service Division, the Human Rights Commission, the Equal Employment Opportunity Commission and other federal agencies; testifies in court or administrative hearings as required.
  • Performs mediation activities in accordance with alternative dispute resolution policies and procedures.
  • Other duties related to equal opportunity, non-discrimination, and HR operations as assigned.
