ATTORNEY III

Position Summary

Attorney III is responsible for supervising the Attorney II and the Legal Support Specialist in the Public Employee Claims Division. The Attorney III also carries his or her own workload, which includes insurance litigation in workers' compensation and property and casualty subrogation, Medicare litigation involving workers’ compensation issues, and any of the subsets of these lines of authority.  Attorney III is also responsible for legal research and providing legal and claims advice to the Public Employee Claims Manager, Commerce Program Supervisors, Claims Coordinators, and Claims Analyst; providing training to agencies in handling workers’ compensation claims; handling Medicare Conditional Payments; and Workers’ Compensation Medicare Set-Asides. This Attorney III position is also frequently assigned special projects by the Public Employee Claims Manager.

 

Special Job Requirements

Occasional in-state travel to attend fact finding meetings, advisory meetings, hearings, and administrative and judicial proceedings is required.  Occasional out-of-state travel related to agency legal matters may be required.

  

This position requires on-site employment with no remote or hybrid options available.

 

Required Certificates

Must be licensed as an Attorney in the State of Arkansas. 

 

 Preferred Qualification

Five years’ experience practicing workers’ compensation law, any number of years of litigation experience in state or federal court, any number of years of administrative law or regulatory law experience strongly preferred.

 

Job Responsibilities and Expected Results 

Attorney III is responsible for conducting legal research and writing legal documents for use in litigation and administrative proceedings, providing legal assistance to the agency, and supervising subordinate attorneys and legal administrative support staff.  Attorney III supervises and manages support staff and subordinate attorneys by interviewing, hiring, providing training, assigning workloads, and evaluating the performance of incumbents.

 

The Attorney III further provides legal services and advice to management and divisions on a broad range of matters, as well as representing the agency in litigation including administrative and judicial proceedings in state and federal courts.  These responsibilities include drafting pleadings, briefs, and subpoenas, as well as responding to subpoenas.  The Attorney III also interprets and analyzes state and federal law, as well as drafts legislation and other policy documents, and promulgates new Department rules and amendments to existing rules.  Attorney III may also develop and prepare budgets.

 

In some cases, Attorney III may also be responsible for supervising outside attorneys, appraisers, and independent actuaries, certified public accountants, or other professionals or specialists hired as examiners by the Department to conduct examinations pursuant to Ark. Code Ann. § 23-61-203.
