In the role of Midwest Transplant Network (MTN) Assistant General Counsel, this individual is responsible for supporting the organization by providing legal advice on a wide range of matters involving employment law, contract review and negotiation and records requests including providing counsel, recommendations, interpretations, legal advice and guidance to MTN team members, while ensuring the appropriate consideration of strategic legal issues and risk management in achieving the MTN Mission. As requested, the position will work with designated MTN Outside Legal Counsel on issues as determined necessary or prioritized by the General Counsel, the executive team and/or the governing board. This position will also assist with maintaining a compliant privacy program and ensuring that MTN’s policies that protect the integrity of health information are enforced.
ESSENTIAL JOB FUNCTIONS
- Serves as a legal resource and provides counsel to the Human Resources (HR) team
- Assists the HR team with employment law concerns, employment law policy creation, revision and claims (i.e., EEOC, unemployment hearings, etc.)
- Works with the Chief People Officer and Manager, HR to establish employment related training
- Assists with the internal investigative process of personnel issues and/or the Corporate Compliance Program as directed by General Counsel
- Maintains knowledge of the organization’s operations and legal documents and reviews legal and corporate filings to ensure compliance with relevant retention schedules
- Conducts legal research and analysis on relevant laws, regulations, and case law, writing legal memoranda as requested
- Serves as a real-time/on call resource to clinical staff for legal issues, which may arise during donation cases
- Drafts, reviews and negotiates contracts, agreements and other legal documents
- Assists General Counsel in managing litigation, including reviewing motions, discovery, pleadings, and communicating with outside counsel
- Assists the Quality Department in responding to subpoena requests or requests for clinical/other records
- Attends MTN Advisory Board meetings and other Committee meetings as requested, serving as a secretary to record and maintain records of meetings
- Conducts regulatory research and monitors legislation as requested by General Counsel to assist in ensuring MTN’s Leadership team is informed of legislation, regulations or other legal events, which may impact tissue or organ donation or transplantation.
- Supports the General Counsel in minimizing risk to the organization
- Helps oversee the implementation of the MTN Conflict of Interest and Disclosure process
- Participates in the investigation and resolution of adverse events or other potential liabilities as requested
- Participates in MTN internal process audits as assigned
- Ensures compliance with trademarks and licensing requirements
- Collaborates with the Information Technology (IT) Department, to identify and address privacy policies and procedures that require improvement.
- Assists in drafting and revising policies and procedures related to health information and use; ensures strict adherence by all staff with access to health information.
Qualifications
QUALIFICATIONS AND PHYSICAL DEMANDS
- Juris Doctorate degree with 2 or more years of legal experience, primarily related to employment law.
- Member of the Bar in the State of Kansas in good standing, or ability to be licensed within one year of employment.
- Previous healthcare, contract management or data privacy experience preferred
- Ability to work a minimum of 40 hours per work and respond to legal inquiries related to clinical cases on a 24-hour basis.
