Job Summary

•    Serve as primary point of contact for our geographically-distributed sales teams supporting our U.S. government customers.
•    Review, redline, and complete representations and certifications (“reps and certs”) and purchase order documentation for our U.S. government sales.
•    Draft, negotiate, and maintain contracts for the sale of commercial products and commercial services to U.S. government and related customers (e.g., federal systems integrators, resale partners, hyperscalers), including master purchase agreements, end user terms, partner agreements, teaming agreements, NDAs, professional services agreements, statements of work, subcontract agreements, and SaaS agreements.
•    Identify contractual issues, including redlining of terms and conditions, that are problematic or inconsistent with playbooks and company processes. Partner with sales teams to negotiate terms and conditions to facilitate sales.
•    Maintain and develop templates related to the sale of commercial products and commercial services to U.S. government customers, and maintain templates for flow down of terms to subcontractors and suppliers.
•    Advise sales, finance, operations, and service delivery teams regarding compliance with contractual rights and obligations.
•    Assist with reviewing and determining viability of NetApp’s participation in RFQs, RFIs, and other solicitations, and contribute to proposal responses, reps and certs, and other certifications as necessary.
 

Job Requirements

•    Bachelor’s degree with a minimum 10 years of legal experience, including at least five years in-house experience at a technology company or technology reseller, with considerable experience drafting and negotiating commercial technology contracts with U.S. government customers. Proven ability to negotiate and manage from cradle to grave, large, commercial product and services agreements.
•    Keen attention to detail and exceptional time management skills, with a demonstrated ability to manage multiple, competing requests while maintaining composure and attention to detail.
•    Excellent knowledge of the public sector procurement laws, regulations, and procedures in the U.S. including FAR, DFARS, and other agency-specific supplemental clauses. Strong background with all types of public sector buying vehicles (GSA, SEWP, agency-specific IDIQs and BPAs, etc.).
•    Solution-oriented:  You bring empathy and understanding to your conversations with customers, seeking to find a path forward that balances company risk and customer needs, and you think creatively beyond the legal terms to generate possible solutions and options for the business.
•    Ability to thrive in a high performance, fast-paced environment and to multitask, prioritize effectively and execute quickly.
•    Team-oriented, with a good sense of humor and high level of integrity, responsibility and professionalism, along with strong interpersonal and people skills. 

Additional Qualifications

•    Experience working with classified contracting.
•    Experience with state and local government contracting.
•    Experience with contract reporting requirements.
•    Project management experience.

Work Location

This position is based in NetApp U.S. Public Sector, Inc.’s office located in the Washington, D.C. metro area. The position is a hybrid position, with a minimum of 2 days per week in the office.
