Team Overview:

The SFM legal team is a seasoned group of attorneys, paralegals, legal analysts and administrative support professionals. Our goal is to provide timely, business-oriented legal solutions that advance SFM’s business objectives, while protecting its legal and financial interests and reputation. We support all aspects of SFM’s business including providing advice and counsel to senior management, negotiating complex investment transactions, drafting and reviewing contracts, managing disputes and litigation, and ensuring compliance with applicable laws and regulations.

 

Position Overview:

SFM is seeking an experienced, business-minded employment attorney to join its team as an Assistant General Counsel (“AGC”). The AGC will be responsible for advising the firm on all aspects of domestic and international employment law, with the goal of minimizing both legal and reputational risk, as well as protecting the firm’s interests.

Major Responsibilities:

Legal Counsel and Advice:

  • Provide strategic and commercial legal advice to the GC, COO, CAO and other cross-functional stakeholders and senior leaders on a broad range of employment matters including but not limited to; hiring/on-boarding, wage and hour laws, workers compensation, performance management, investment and non-investment compensation structure, benefit plan construction and compliance and leaves of absence and other workplace policies.
  • Draft and review global offer letters, Portfolio Manager Agreements, Separation Agreements, Severance Agreements and other employment and HR related Agreements to minimize complexity, mitigate risk and ensure consistency with relevant laws, regulations and Firm policies.
  • Primary ownership of the firm’s Employee Vesting Plan, Severance Pay Plan and Global Partnership Agreements.
  • Partner with the CAO and HR team and advise on potential risks associated with non-competes, non-solicits and non-disclosure provisions applicable to incoming employees relating to their former employment.
  • Oversee and manage all active and threatened employment related litigation, including responding to pleadings, 3rd party subpoenas or other discovery demands and collaborating and liaising with external counsel as needed.
  • In all matters manage outside counsel and effectively intermediate between outside counsel and internal clients.

Employee Relations and Employee Compliance Management:

  • Monitor and advise on compliance with federal, state and local employment laws, including with respect to wage and hour regulations, family and medical leave laws, anti-discrimination laws, GDPR and global privacy laws and legal and contractual obligations around disclosure of confidentiality and proprietary information.
