DUTIES & RESPONSIBILITIES:

The ideal candidate will have general environmental law expertise. The position will involve:

  • Providing legal advice to internal Environment & Sustainability clients, including Remediation, Operations, Engineering, Permitting and various railroad operations clients.
  • Assess and advise on compliance for various rail facilities and work with the team to address enforcement issues.
  • Reviewing, drafting and leading the negotiation of consent decrees with a variety of Federal and State Agencies.
  • Monitor and track legal and regulatory developments.
  • Reviewing, drafting, and negotiating environmental provisions in documents associated with real estate transactions and sourcing agreements.
  • Proactively identifying risk to the company and finding ways to minimize the risk.
  • Researching and resolving general environmental matters affecting the company.
  • Handling environmental litigation, including choosing appropriate outside counsel, overseeing their work, and handling cases in-house when appropriate.

 

 

BASIC QUALIFICATIONS:

  • Juris Doctorate from an ABA-accredited Law School with strong academic record.
  • Admitted to practice and in good standing in at least one state.  Formal Court appearances are not anticipated.
  • 5 plus years of experience focused on general environmental legal matters, with general knowledge of the CAA, NEPA, CERCLA, RCRA, and the CWA.
  • Excellent legal analytical, research, verbal and written communication and advocacy skills.
  • Commitment to working as a team.
  • Able to communicate effectively to all levels of the organization.
  • Knowledge of Lexis research system and web-based legal research tools, as well as proficiency in Microsoft Office suite.
  • Ability to handle multiple complex and challenging assignments and projects in a timely and efficient manner.
  • Ability to interact professionally, effectively, and diplomatically with internal and external clients as well as Federal, State, and local entities.
  • Commitment to Environmental compliance and excellence.
  • Ability to travel approximately 25% of the time and/or based on business need.

 

 

PREFERRED QUALIFICATIONS:

  • Experience in construction permitting (CWA §§ 401 and 402, NHPA § 106).
  • Experience or knowledge of HazMat issues and regulatory agency oversight of HazMat response.
  • Experience in Federal Indian Law and the intersections between Indian Laws and Environmental Laws.
