Position Overview
This position, under direction of the Chief Legal Counsel, serves as the agency’s Assistant General Legal Counsel. The ideal candidate for this position will have the ability to communicate professionally, clearly, and effectively both verbally and in writing, work in a fast-paced environment, be highly organized, and be capable of multi-tasking to keep up with the demands of a busy and growing agency. Essential Functions
1. Serves as Agency Assistant General Legal Counsel.
• Advises General Counsel/Ethics Officer on the course of action on diverse legal issues confronting the Board from outside law enforcement agencies as well as compliance with State laws and the Illinois Police Training Act.
• Travels to attend all quarterly Board meetings and associated committee meetings.
• Assists in performing parliamentarian duties and provides legal direction to the Board member with legal direction concerning confidential issues, including legal proceedings, legal questions, legislative matters, and personnel issues relative to the agency.
2. Assists General Legal Counsel in administration and implementation of policies concerning the processing of legal inquiries, subpoenas, documents, records, and regulations to ensure that staff handles and processes documents within legal restraints and confidentiality requirements.
• Assists in answering subpoenas, freedom of information requests or other forms of inquiries pertaining to State records, police personnel and training records and employee records.
• Aids in the review of contracts and grant awards to ensure that they contain proper language and are within State of Illinois regulations.
• Responds to requests for information and documentation relative to the legal department as part of the agency’s compliance audits.
3. Researches consults with, and offers advice to agency human resources and management staff, and other necessary State agencies relative to the legal aspects of personnel matters including:
• Interpretation of bargaining unit contracts and personnel rules of the State of Illinois.
• Application of discipline of both bargaining unit and merit comp employees, including reprimands, suspensions, and discharges.
• Response to both bargaining unit and civil service grievances.
• Arbitrations.
• Worker’s compensation.
• Harassment complaints and investigations.
• Family and Medical Leave Act (FMLA).
• Americans with Disabilities Act of 1990 (ADA), Title VII of the Civil Rights Act of 1964, Age Discrimination in Employment Act, Pregnancy Discrimination Act, and other applicable State and Federal human rights laws and employment laws.
• Serves on the Agency’s Reasonable Accommodation Request Committee.
• Represents the agency in union grievance hearings and arbitration.
4. Assists Chief and General Legal Counsel in the drafting of legislation, resolutions, administrative rules, and amendments pertaining to law enforcement and corrections officers, Board funding or other law enforcement related issues.
• Confers with law enforcement groups and members of the General Assembly.
• Represents the Board at legislative hearings/committees.
5. Conducts and directs confidential investigations pertaining to the decertification of law enforcement officers, including those convicted of a felony/misdemeanor.
• Ensures that the Board acts in accordance with State statute and due process principles.
6. Performs other duties as required or assigned which are reasonably within the scope
of the duties enumerated above.
