What you'll do
As Senior Director, Associate General Counsel, Product & Regulatory at Brex, you will lead the product and regulatory legal team, and own the strategic legal determinations and advice provided on legal and regulatory requirements through the product life cycle. You will serve as a proactive and business-oriented legal partner to senior business executives within product, engineering, marketing, sales and partnerships on a range of issues related to product development in the financial services and payments sector and develop pragmatic solutions and risk mitigation approaches that balance legal and business objectives within areas of regulatory ambiguity.
Having experience scaling a product legal team function, you will be responsible for training, managing and developing lawyers into best-in-class product and regulatory counsel that provide front line legal support and guidance for product development and launches in domestic and international jurisdictions, ensuring legal expertise and ingenuity is applied toward operating within relevant regulatory frameworks.
Responsibilities
- Primary responsibility for ensuring pragmatic, tactical and actionable advice on legal and regulatory requirements for financial products and software in key global markets, becoming an expert in Brex’s Empower platform, its financial products and services, data usage and security, operations, key partnerships and the laws and regulations that govern them in these markets
- Partner closely with Product, Engineering, and Go-To-Market leadership to identify and execute strategic opportunities for rapidly scaling Brex’s financial product and service offerings and features, including supporting the legal needs for Brex’s international efforts
- Proactively monitor, understand and advise on relevant regulations, regulatory actions and industry practices to provide best-in-class legal advice to facilitate launching compliant product offerings both domestically and abroad
- Draft customer agreements and terms and work closely with teams across the company to develop customer experiences and identify and resolve issues relating to Brex’s product offerings
- Advise on issues related to the SaaS product lifecycle and data protection as related to Brex’s products and services
- Structure, draft, and negotiate agreements with financial institutions and technology providers to support our products and services
- Provide guidance for strategic decisions and risk, including those relating to product structuring and implementation
- Partner closely with the Compliance team to develop and implement scalable processes to address legal and regulatory risks
- Partner with and supervise outside legal vendors who are engaged to assist in the provision of legal advice and services
- Manage other product and regulatory lawyers and legal professionals with a focus on ensuring the provision of best-in-class legal support across Brex and the team’s growth and development
Requirements
- 12+ years combined legal experience, including in-house experience at a fintech or financial services company (high growth environment preferred) working with complex federal, state and international regulatory frameworks
- Experience managing and developing a high-performing team of product counseling attorneys
- Deep knowledge of US laws and regulations applicable to a variety of financial services products and services with a strong familiarity with payments, lending and/or card products
