Job Description Summary
The Senior Contracts & Negotiation Manager is responsible for using business and legal judgment to analyze, structure, draft, review, and negotiate contracts with strategic and key customers, distributors, group purchasing organizations, and governmental entities for all product modalities within the Pharmaceutical Diagnostics business. Ensure customer requests for proposal / information (RFPs and RFIs) are complete, accurate, and submitted timely. Applies sound judgment to identify, evaluate and negotiate contract terms and conditions and other related requirements/risks. Lead process improvement initiatives to support our lean strategy.Job Description
Roles and Responsibilities
- Advise sales and business teams on agreement structure, risks, and alternatives
- Collaborate with various business functions including Legal to draft and negotiate a wide variety of contracts
- Consult with legal team, compliance, and other business functions to ensure that templates are in compliance with legal requirements and best practices
- Facilitate cross-functional meetings; manage agenda, post minutes, and manage participants
- Actively participate and assist with executing new product launches
- Assist with executing price increases and price adjustments
- Assist with managing contract templates including the systematic review of templates and playbooks and incorporate best contracting practices and provisions
- Assist with maintaining SOPs and Guide Sheets specific to Contract Authoring
- Collaborate with trainers to design and deliver training materials for Sales with respect to contracting processes, policies, and procedures
- Assist with training Comm Ops staff on contracting processes
- Assist with managing the queue for contract requests; assign work to ensure team meets / exceeds business cycle requirements
- Actively participate in the periodic review of 5.0 and 6.0 flags to ensure they meet the needs of PDx
- Participate in Commercial Deal Review meetings as necessary to evaluate deal structures
- Identify, participate, and lead process improvement initiatives to support our lean strategy
Required Qualifications
- Bachelor’s Degree or paralegal certification with 7+ years of related experience
- Minimum of 5 years of experience with contract drafting and negotiation with customer/client interaction and managing successful relationships
- Experience in the HealthCare, Pharmaceutical, and/or Life Sciences industry
- Demonstrated experience prioritizing conflicting demands from multiple business clients in an extremely fast-paced environment
- Ability to interact and communicate effectively with individuals from multiple departments at all levels of the organization
- Excellent interpersonal, influencing and negotiation skills
- Strong written and verbal communication skills, language proficiency in English
- Ability to work successfully towards strict deadlines, as well as independently on multiple, simultaneous assignments
- Proficient with Microsoft Office (Word, Outlook, Excel, PowerPoint)
- Enable collaborative culture and drive organization to improve customer/client satisfaction levels and responsiveness
Desired Characteristics
- JD or MBA Preferred
- Experience negotiating and drafting complex multi-year supply agreements
- Prior experience with public bid rules and doing business with governmental entities
- Strong financial acumen with an understanding of contractual accounting methodologies
- Experience using, developing, and/or implementing a Contract Lifecycle Management system
- Experience using SAP
- Experience using Salesforce.com
- Understanding of channel strategy and go-to-market options
- Green Belt / Black Belt Certification
- Project Management Certification
