Job Description

ESSENTIAL DUTIES AND RESPONSIBILITIES: 

The Sr. Director/Assistant General Counsel, Global Trade and ABAC Compliance is responsible for providing strategic and legal guidance regarding Western Digital’s export and import compliance program and for implementing and overseeing its antibribery and anti-corruption (ABAC) program. Leading the Global Trade Compliance program includes ensuring compliance with the Export Administration Regulations (EAR), Office of Foreign Asset Controls (OFAC) regulations and programs, economic and trade sanctions programs, Trade Agreement Act (TAA), Customs and Border Protection (CBP) regulations, other applicable import/export laws and regulations in countries where Western Digital has operations, and WDC’s Global Code of Conduct. Leading the ABAC Program includes ensuring compliance with FCPA, UKBA and other applicable corruption laws and regulations, driving implementation of third-party risk management controls within procurement and sales business processes, managing risk-based diligence processes for third parties and advising the Company on distributor channel compliance solutions.

The  Sr. Director/Assistant, Global Trade and ABAC Compliance will partner with many high-level stakeholders in the Company to provide guidance on trade compliance regulations, enabling the business to navigate complex trade regulatory landscapes in a compliant and pragmatic way. Successful candidates must demonstrate their ability to:

  • Lead, manage and develop two distinct global teams within Company’s ethics and compliance function, one a team of skilled global trade professionals and the other comprising ABAC and enhanced due diligence specialists.
  • Direct the creation and maintainance of trade compliance policies & guidelines;
  • Provide clear and timely guidance and advice to ensure WDC and its subsidiaries, affiliates, and partners comply fully with all applicable trade laws and regulations, including the EAR, OFAC and other sanctions programs, TAA, CBP and other U.S. and international regulations;
  • Advise and lead on drafting of strategic export licenses and other regulatory filings;
  • Direct the development of trade compliance program’s continuous improvement activities, including compliance assurance and risk assessment programs;
  • Monitor legal, regulatory, and trade developments that impact WDC’s business and deliver clear and timely legal guidance to mitigate impacts;
  • Direct, develop and execute risk-based trade compliance trainings and communications;
  • Collaborate with various business functions (including colleagues in Legal, Finance/Tax, HR, Engineering, Supply Chain, Marketing and Sales, Corporate Strategy) to understand their business priorities and build integrated, upstream and forward-looking trade compliance processes;
  • Develop, advise on and drive compliance with effective anti-corruption policies and procedures governing conflicts of interest, gifts & entertainment, discounts and incentive programs and market development funds;
  • Drive implementation of third-party risk management controls within procurement and sales business processes, managing risk-based diligence process for third parties and advising the Company on distributor channel compliance solutions;
  • Lead projects to enhance trade and ABAC compliance efficiency and value contribution;
  • Lead the development of trade and ABAC compliance roadmap and strategic planning; and
