Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States. 

 

Position Summary: This Assistant Attorney General position is in the Office of the Attorney General within the Criminal Appeals Unit in Miami, Florida.

 

Pay: $83,522.92 Annually

 

Qualifications: 

Admission to the Florida Bar and two (2) years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

 

The Work You Will Do: The responsibilities of this position include, but are not limited to the following: 

CRIMINAL APPEALS: Represent the State of Florida in all criminal appeals filed with the District Court of Appeal and the Florida Supreme Court.

This position requires as a prerequisite to employment a degree of Bachelor of Laws or Juris Doctor from an accredited law school and membership in the Florida Bar.

DIRECT AND POSTCONVICTION APPEALS: Supervise the timely filing of necessary pleadings and documents comprising the record on appeal; review the assignments of error; conduct research necessary to prepare and file briefs setting forth contentions and positions of the State of Florida with respect to the issues involved; oral argument and all other responsibilities attending the prosecution of a criminal appeal.

FEDERAL HABEAS CORPUS PROCEEDINGS: Represent the appropriate state official in habeas corpus proceedings filed by state prisoners in the federal courts in the District Courts for Florida.

Respond to the claims of prisoners asserting federal constitutional rights violations. This necessitates review of all the state court proceedings resulting in the conviction questioned, the supervision and preparation of the necessary pleadings and responses needed to set forth the contentions and position of the State of Florida (including the supervision and preparation of requisite exhibits with respect to the issues raised), handling all hearings and the preparation of post-trial proceedings.

Handle appeals from any of the foregoing proceedings to the United States Court of Appeals for the Eleventh Circuit and to the United States Supreme Court.

EXTRAORDINARY WRITS: Handle extraordinary litigation in both state and federal courts where appropriate. Handle any other special assignments or duties assigned by the Bureau Chief including civil litigation, special projects, postconviction litigation and opinions.
