Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States. 

 

Position Summary: This Senior Assistant Attorney position is in the Office of the Attorney Gerenal within the Antitrust Enforcement Unit in Tallahassee, Florida.

 

Pay: $119,303.60 Annually, commensurate with experience

 

Qualifications: 

Admission to the Florida Bar and six (6) years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

 

Preference will be given to candidates with at least two years of experience in complex litigation, including but not limited to the prosecution or defense of cases involving anticompetitive practices, deceptive trade practices or antitrust.

 

The Work You Will Do: The responsibilities of this position include, but are not limited to the following: 

The Antitrust Division is seeking a motivated attorney to join a collaborative and dynamic legal team that investigates and enforces cases under state and federal antitrust laws, Florida False Claims Act, Florida securities law, Civil Racketeering and as needed civil complex enforcement of the Florida Consumer Protection Act. The Division’s caseload includes cutting-edge and high-profile matters that receive national attention. The Division collaborates with the U.S. Department of Justice, the Federal Trade Commission, other state attorneys general and Florida agencies. This position is located in Tallahassee, Florida. The Florida Attorney General’s Antitrust Division is a nationally recognized leader that positively impacts the lives of Floridians.

 

 

  1. INVESTIGATION OF ANTITRUST VIOLATIONS

 

The candidate will plan, organize and direct a team approach to industry-wide investigations, with an emphasis on those involving purchases by the State and/or local governments, by combining the skills of attorneys, economists, data processing professionals, investigators, and supporting paraprofessional and clerical personnel to gather, analyze and interpret the antitrust significance of observed marketplace behavior as revealed by all available relevant data.

 

Analyze and evaluate business practices in order to make initial determination of whether violations of state or federal antitrust laws may have occurred.

 

Interview fact witnesses and/or direct an investigator in conducting such interviews.

 

Obtain evidence in the form of sworn testimony, answers to written interrogatories and/or documents by means of antitrust Civil Investigative Demands (CIDs).

 

Obtain proffers of testimony from prospective witnesses.

 

Prepare pleadings and legal memoranda and present oral argument on issues involved in legal challenges to compulsory investigative demands.

 

Coordinate investigative efforts with other interested law enforcement agencies, including local state attorneys, attorneys general of other states, the Antitrust Division of the United States Department of Justice and the Federal Trade Commission.

 

Report to the Antitrust Division Director regarding the results of investigations and makes recommendations regarding enforcement options.
