Commercial Counsel (Advertising & Privacy)

Fluent is seeking an in house Commercial Counsel that will focus on Advertising and Privacy matters.

What You'll Do:

• Counsel various teams on legal issues to help ensure compliance with applicable advertising laws and regulations, consumer protection laws and regulations, privacy and intellectual property laws, and other legal requirements
• Prepare, review and negotiate contracts with our advertiser and publisher clients and other third parties and manage work allocation
• Support our Product teams with the launch of new features and product offerings
• Draft, review and edit user terms and conditions and privacy policies for our owned and operated websites in the United States and UK, Canada and Australia
• Understand Fluent’s products and offerings to provide effective advice and guidance to our internal teams
• Organize and archive various agreements with advertiser and publisher clients, including non-disclosure agreements, terms and conditions and insertion orders
• Provide privacy guidance and related risk management advice to all teams across the company
• Manage privacy processes like data protection impact assessments and data privacy requests
• Provide legal support on HR and employment issues; review employment agreements as needed
• Collaborate with other members of the legal and compliance team with respect to the overall Legal and Compliance functions for the company

• Provide legal support services to GC in the form of basic legal research, agreement drafting and compliance

Requirements

• At least 2-5 years’ experience in-house or at law firm, specializing in advertising law, promotional marketing, technology, IP and/or privacy law; prior in-house experience at a fast-paced and dynamic organization preferred
• J.D. and admission to the bar and in good standing or the ability to practice in-house in your office location, preferably NY

Preferred Qualifications

• Strong organizational, analytical, written, and verbal communication skills
• Experience negotiating contracts for advertising, performance marketing and data campaigns
• Detail oriented and ability to identify and diligently resolve problems
• Highly motivated, self-starter who takes initiative
• Excellent organizational and time management skills - ability to prioritize and juggle multiple tasks
• Familiarity with advertising, promotional marketing, data privacy and technology law
• Knowledge of the FTC Act, ROSCA, TCPA, CAN-Spam, Telemarketing Sales Rule, and CCPA/CPRA, GDPR and other data privacy laws a plus

Salary Range: $140,000 to $200,000 - The base salary range represents the low and high end of the Fluent salary range for this position. Actual salaries will v
