About the role

The Legal team is responsible for managing the legal affairs of the company, including providing legal counsel across the organization, handling disputes, and creating and enforcing intellectual property.

ResMed is looking for a dynamic, results-oriented Privacy & Product Counsel to support ResMed’s mission to improve the quality of life of our patients, customers, and partners. As part of ResMed’s product legal team, you will provide best in class support to ResMed’s product owners and business functions, with an emphasis on supporting ResMed’s digital health solutions for healthcare providers and managing complex privacy-and data-related considerations.

Let’s Talk About Responsibilities  

  • Work as part of a global product legal team to deliver best-in-class product counseling and privacy support to ensure ResMed’s products, services, platforms and technology comply with applicable laws and privacy-by-design principles.

  • Establish and maintain excellent working relationships with business and product stakeholders, and work proactively to identify, mitigate, and address risks.  Be the main point of contact for one or more business units, establishing strong partnerships and providing first-class support.

  • Analyze products and initiatives to provide practical legal support, risk mitigation, and privacy risk assessment with a global and customer-centric mindset.

  • Provide advice on the application of healthcare regulations and global privacy laws to new product initiatives, with an emphasis on HIPAA/HITECH and other North American privacy and healthcare laws (e.g., AKS, CPRA, MHMDA).

  • Draft, review, negotiate, and manage commercial agreements or analyses required to enable product development.

  • Draft, review, negotiate, and manage privacy related legal documents, including privacy notices, data processing agreements, data transfer agreements, business associate agreements, etc. Where applicable, complete privacy impact assessments and documentation to manage risk vis-a-vis business value within a global privacy program.

  • Collaborate with other legal and privacy team members to offer consistent guidance on key areas that cross the organization such as data use rights, data governance, consent, machine learning, data science, platform integration, contracts, etc.

  • Stay on top of regulatory trends for cutting-edge technologies, understand their potential implications to the digital health solutions of ResMed, and navigate the business through the complexity of such new areas to success.  

Let’s Talk About Qualifications and Experience  

  • 5 or more years of relevant legal experience in-firm or, preferably, in-house in a product or privacy counsel role. Experience in the digital space, particularly in SaaS, digital health technology, or the medical device and/or technology sector, is also preferred.

  • A juris doctorate (J.D.) with privacy experience and good standing in a state bar association or equivalent. One or more privacy certifications from recognized institutions, such as one of IAPP’s Certified Information Privacy Professional (CIPP) certifications, preferred.

  • Strong knowledge of and experience with healthcare regulations, privacy laws, and leading data protection frameworks, particularly those applicable to digital healthcare. Experience with HIPAA/HITECH is preferred, particularly in a business associate capacity.

  • Exceptional communication and organizational skills with a growth mindset including a strong desire and ability to make complex topics understandable for various audiences.  

  • Experience with proven ability to mitigate risk and enable innovation.

  • Customer service focused with excellent analytical and problem-resolution skills. Solution-oriented with the ability to think strategically and give practical advice by balancing business needs with legal risks.
