This course examines the dialogue between comparative law and legal history. It will explore elements of common law, civil law and customary law firstly through continental lenses such as African, South-Asian and European legal history. Secondly, via a comparative lens focused on law as a mechanism of power. It depicts the strategies that laws employed to bolster and entrench the discursive strategies of the ruling power. For comparative purposes, the  management and control of groups in European and non-European colonial settings will be emphasised. Particular  attention is given to how legal theories developed in support of differences between the colonial groups and the subjugated, but also within and between colonised groups. The course reveals how well-developed race-ranking systems emerged in colonial legal systems that endorsed dispossession, injustice and genocide.

TQR: At a minimum, a first degree in law. Several years of significant practice or professional experience, in the relevant area; Experience in teaching undergraduate law students in a bilingual setting.

The University may, at its discretion, assign the person of choice to give this Course/Teaching.
