Assistant General Counsel, Privacy

The Privacy function sits within the Legal and Compliance teams and is responsible for advising cross-functional stakeholders located within the US and international community. We are searching for an individual who can lead this function and the dedicated privacy professionals working to ensure that our best-in-class product continues to comply with the ever-changing privacy regulatory environment.
As Assistant General Counsel, Privacy, you will be responsible for providing legal, regulatory, and domain-specific expertise to manage and expand a comprehensive global Privacy and data protection program that spans across internal and consumer-facing products and commercial agreements.
The ideal candidate will be a self-motivated, driven, and experienced leader that is comfortable supporting a fast-growing business and partnering with various functions and business units across the organization, as well as managing and setting expectations for our internal Privacy team.
About this role (Responsibilities)
- Lead the company’s Privacy function with the ongoing enhancement, development, and management of a comprehensive program (including policy development, individual rights compliance, training, third party management, incident response etc.)
- Work closely and collaboratively with cross-functional teams and stakeholders to understand, research, analyze and advise on new products, services, technologies and processes impacting Toast’s business and customers
- Provide guidance and consultation to our business on Privacy program initiatives and compliance as part of our day-to-day business operations or as part of larger projects (including commercial, marketing, product development, corporate development, HR, security and other subject matters)
- Support and manage any ongoing privacy projects and requirements across our operations, including management of various global privacy projects, drafting and operationalization of new policies and governance, product rollouts and other privacy program initiatives
- Think creatively and uniquely to navigate complex regulatory environments to
ensure a smooth user-experience and compliance - Create internal processes and policies designed to ensure best-in-class
Privacy practices and an effective roll-out of new products - Develop, monitor and assess the impact of new privacy and security regulatory developments and the resulting impact to Toast’s business units globally
- Provide privacy and security-focused drafting and contract negotiation support to the commercial legal team for new vendor, partner and customer agreements (and third-party management generally)
- Remain up-to-date on relevant laws and regulations and provide advice to the
business stakeholders
Requirements
- Have at least 10+ years of relevant in-house legal department experience leading Privacy programs and advising senior leaders across various internal teams on privacy related matters for new products, product enhancements, and consumer related issues
- Experience scaling and managing a team of Privacy attorneys
- Significant experience advising on and supporting compliance with GDPR and other related global legislation
- Experience negotiating privacy and security provisions in technology agreements
- Experience managing large cross-functional privacy projects preferred
- Policy drafting experience (both internal and external-facing) preferred
- Ability to break down complex and often ambiguous requirements into actionable advice
- CIPP or similar certification preferred
- Strong interpersonal and communication skills (both verbal and written)
- Experience working in a fast-paced environment; Fintech, software and/or other technology companies preferred
